General Terms and Conditions (GTC)

1. Scope

  1. These General Terms and Conditions apply to all contracts between Immosthetics, owner: Larissa Ost, Im Mediapark 5, 50670 Cologne, Germany, and its customers for services in the areas of real estate brokerage, consulting, digital exposés, and online bookings.

  2. Any deviating or supplementary agreements require written consent.

2. Services

Immosthetics offers the following services, among others:

  1. Real estate brokerage (purchase, sale, rental)

  2. Consulting on real estate matters

  3. Creation and provision of digital exposés

  4. Organization of viewing appointments, also bookable online via the website

  5. Provision of information material and online services on the website

The exact scope of services is specified in the respective contract, offer, or online booking. Any additional agreements must be confirmed in writing.

3. Conclusion of contract

  1. Contracts are concluded when the customer accepts an offer or Immosthetics confirms the service in writing.

  2. Appointments booked online via the website become legally binding upon confirmation by email.

  3. Offers made by Immosthetics are subject to change and non-binding unless expressly marked as binding.

4. Fee / Commission

  1. Immosthetics receives a fee for brokering real estate in accordance with § 34c GewO(German Trade Regulation Act).

  2. The amount and due date of the fee are specified in the individual contract, offer, or statutory provisions.

  3. The fee is payable regardless of whether the purchase or rental agreement is concluded, provided that proof or mediation has been provided.

  4. Prices for digital services (e.g., exposés, online consulting) are agreed upon separately.

  5. All prices are subject to statutory value added tax.

5. Obligations of the customer

  1. The customer shall ensure that all information provided is truthful and complete.

  2. In the case of brokerage orders, the customer shall inform Immosthetics immediately if they find a buyer, tenant, or interested party themselves.

  3. The customer undertakes to provide their own functional devices and internet access for the use of digital services (e.g., booking system).

6. Online bookings

  1. Appointments booked via the website are considered binding as soon as confirmation is received by email.

  2. Costs for digital consulting services or viewing appointments will be charged in accordance with the offer or booking confirmation.

  3. Cancellations or changes must be made in writing at least 24 hours in advance, otherwise a cancellation fee may be charged.

7. Digital exposés

  1. Exposés, presentations, and other provided content remain the property of Immosthetics.

  2. The customer receives a simple right of use for the agreed purpose.

  3. Any disclosure, reproduction, or publication without consent is prohibited.

8. Liability

  1. Immosthetics shall only be liable for intent and gross negligence.

  2. Immosthetics shall only be liable for slight negligence insofar as essential contractual obligations (cardinal obligations) are breached.

  3. No liability for content provided by the customer or for external links on the website.

  4. Liability for financial decisions made by the customer or the creditworthiness of third parties is excluded.

9. Revocation and withdrawal

  1. Consumers within the meaning of § 13 BGB (German Civil Code) may withdraw from the contract within 14 days without giving reasons, insofar as this is legally permissible.

  2. Consultations or exposés booked online are not subject to the right of withdrawal once the service has been provided in full and the customer agrees that the service will begin before the expiry of the withdrawal period.

10. Data protection

  1. Immosthetics processes personal data exclusively in accordance with the GDPR.
